"Fiducie" (Close to trusts)

Définition
A "Fiducie" is a legal instrument through which a person, the trustee, has the right to manage the trust assets, and is limited by various obligations which generally include transfer of the right after a certain period of time to the settler or a third party (definition of Professor Witz).Fiducia means trust in Latin. Trust operations are based on the trust the settler has toward the trustee.
Thus, a Fiducie is a contract for a temporary transfer of ownership. The trustee must reconvey the asset(s) of the trust once his/her obligations are finished.
Beware not to confuse Trusts and Fiducie. Although the concepts are similar, they are based on separate legal principles.
